Changes to the AUP

RangeForce may revise the AUP from time to time to reflect changes to our services, applicable laws, regulations or standards or other changes that may occur in our business. We shall post the revised AUP on the same webpage where we published this version of the AUPs. We may also use the services, e-mail or other means for notifying you of such changes. The revised AUP will be effective when posted as described unless the document itself specifies a later time for its entry into force.

Your Restrictions and Obligations

When using the Services, you must not do any of the following:

(i) use the Services or the tools provided to you in course of Services in any manner or reason other than completing the task presented by the cyber simulator;

(ii) share your account or account information with any other individual. Use of an account by more than one individual is strictly prohibited;

(iii) carry out any activities in course of using the Services that are illegal, libelous, defamatory, abusive, threatening, harassing, hateful, offensive, causes damage to RangeForce or any third party or otherwise violates any law or infringes upon the right of any third party;

(iv) decompile, reverse engineer, or otherwise attempt to obtain the source code of the Services;

(v) modify the software underlying the Services in any manner or form or to use modified versions of such software, including (without limitation) for the purpose of obtaining unauthorized access to the Service, unless to the extent requested otherwise by Rangeforce in course of a specific practical task;

(vi) publish, post, upload, e-mail, distribute, or disseminate any inappropriate, profane, defamatory, misleading, infringing, obscene, indecent, or unlawful content;

(vii) transmit files that contain viruses, corrupted files, or any other similar software or programs that may damage or adversely affect the operation of the Services or another person's computer, software or hardware, or telecommunications equipment;

(viii) probe, scan or test the vulnerability of the Website and/or Services or circumvent any security mechanism used by the Website or Services, unless to the extent as requested otherwise by Rangeforce in course of a specific practical task;

(ix) take any action that imposes an unreasonably or disproportionately large load on the infrastructure of the Services.

 

(x) interfere with or disrupt the integrity or performance of the Services, attempt to gain unauthorized access to the Services or its related systems or networks, or access, tamper with or use non-public areas or parts of the Services or shared areas of the Services you haven't been invited to.

 

(xi) remove or destroy any copyright notices or other proprietary markings contained on or in the Services. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Services, use of or access to the Services, without express written permission by us.

You warrant that you own or have sufficient legal right to the intellectual property rights in any content you post or upload to the Services and posting or using such content does not violate applicable law or the rights of any third party. You hereby grant RangeForce and its affiliates a lifetime, worldwide, irrevocable, royalty-free, nonexclusive, sublicensable right to use, reproduce, create derivative works of, distribute, publicly perform, publicly display, transfer, transmit, distribute, and publish the content you post on the Services for the purposes of (i) displaying the content on the Services, (ii) processing the content in connection with providing the Services, (iii) distributing the content, either electronically or via other media, and/or (iv) storing or hosting the content in a remote database or on the Services. This license will apply to the distribution and the storage of the content in any form, medium, or technology now known or later developed.

RangeForce reserves the right to suspend or terminate access to its Services immediately to any user, whose activity is disrupting, causing harm to the Services infrastructure or third parties, or otherwise violates the AUP. If RangeForce terminates you and/or the access to our Service due to your breach of the AUP, you shall forfeit any right to any refund for the subscription fees paid. You agree to reimburse RangeForce for any expenses or costs, including consequential damages, we or anyone else may incur as a result of a breach of the foregoing representations and obligations.

Security and Integrity

You agree to (a) comply with any and all reasonable instructions, standards and protocols issued by RangeForce from time to time with respect to the Services; (b) comply with all applicable laws when using the Services; (c) use commercially reasonable efforts to prevent unauthorized access to or use of the Services, and to notify RangeForce promptly of any such unauthorized access or use; (d) implement and maintain adequate internal security measures in connection with the use of the Services, including appropriate procedures for maintaining and updating passwords, ensuring the confidentiality and safe storage of all log in details, user names and passwords, immediately notifying RangeForce if you suspect a breach of your security measures; (e) use at least industry-standard virus protection practices to protect your systems, networks, products and infrastructure against viruses, worms, or other similar security threats; and (f) ensure and be responsible for the accuracy of all data entered by you or provided to RangeForce by whatever method in using the Services. For the avoidance of doubt, you are solely responsible for all content provided, transmitted, maintained, or stored in connection with your use of the Services, including without limitation any information and business rules applied in configuring the Services for its use.  Without limiting the foregoing, you agree:

 

(i) to provide and keep the information about you and/or your organization as requested by RangeForce accurate, current and complete;

(ii) to maintain the confidentiality of your password and other information related to the security of your account;

(iii) to be fully responsible for all use of your account and for any actions that take place through your account, including responsibility for compliance with all laws and regulations that are applicable to you or the content you use or create in connection with the Services.

 

AUP Violations

RangeForce reserve the right, but does not have the obligation, to investigate any violation of the AUP or any misuse, or potential misuse of the RangeForce Service. RangeForce may remove, disable access to or modify any content or resource that violates the AUP or any other agreement between us. Without notice to you (unless required by law), RangeForce may report any activity that we suspect violates any law or regulation to appropriate law enforcement authorities, regulators or other appropriate third parties. RangeForce’s reporting may include disclosing account information and/or content that may belong or pertain to you. RangeForce may also cooperate with law enforcement agencies, regulators or appropriate third parties to help with the investigation and prosecution of illegal conduct by providing information related to alleged violations. If you become aware of any violation of this AUP, you must immediately notify RangeForce and provide RangeForce with reasonable assistance, as RangeForce requests, to stop or remedy the violation. YOU AGREE TO HOLD RANGEFORCE HARMLESS FROM AND AGAINST, AND WAIVE (TO THE EXTENT PERMITTED BY APPLICABLE LAW) ANY CLAIMS YOU MAY HAVE AGAINST RANGEFORCE RESULTING FROM ANY DISCLOSURE, INVESTIGATION OR ACT OR OMISSION OF RANGEFORCE IN THE COURSE OF CONDUCTING OR COOPERATING WITH AN INSPECTION AS SET FORTH IN THIS AUP.
